Terms of Use
These terms are the agreement between you and BDKM, a limited liability company organised under the laws of the State of Maryland ("we", "us"), covering the Spider Hunter mobile game. By downloading, installing or playing the game you accept them. If you do not accept them, do not install the game.
1. Your licence to play
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Spider Hunter on devices you own or control, for your own private, non-commercial entertainment.
That is a licence to use the game, not a sale of it. We keep ownership of the game and everything in it.
2. What you may not do
- Copy, sell, rent, sublicense or redistribute the game or any part of it.
- Reverse engineer, decompile or disassemble the game, or attempt to extract its source code, artwork, models or audio, except to the limited extent the law expressly permits despite this restriction.
- Modify the game, or use cheats, mods, automation tools, emulator manipulation or memory editors to alter gameplay, currency, progression or purchases.
- Interfere with the advertising or purchase systems, or attempt to obtain paid content without paying for it.
- Remove or obscure any copyright, trademark or other proprietary notice.
3. In-app purchases and virtual items
The game offers optional purchases, including removing advertisements. All payments are processed by the store you downloaded from — Google Play on Android, or the App Store on iOS — under that store's own terms. We never receive or handle your payment details.
Coins, suits, upgrades and any other in-game items are virtual items licensed to you, not property you own. They have no monetary value, cannot be exchanged for real money or anything of real-world value, and cannot be transferred outside the game.
Because your progress is stored on your device rather than on a server, virtual items are lost if you uninstall the game, reset the device, or lose it. Please keep that in mind before purchasing.
Refunds
Refunds are handled by the store you purchased from — on Android under Google's refund policy, and on iOS through Apple's Report a Problem. That is where refund requests should be made. Nothing in these terms limits any refund or cancellation right you have under the consumer law that applies to you. If the store declines a request you believe was fair, write to us and we will look at it.
4. Advertising
The game is free to download and is supported by advertising. Ads are supplied by Google AdMob, and what they collect is described in our Privacy Policy. Advertisers, not us, are responsible for the content of their ads and for anything you buy from them. Buying Remove Ads switches advertising off in the game.
5. Ownership
Spider Hunter — including its characters, name, artwork, city, code, music and sound — is an original work of BDKM and is protected by copyright and other intellectual property laws. Third-party components used under licence remain the property of their owners. All rights not expressly granted to you in these terms are reserved.
Spider Hunter is not affiliated with, endorsed by, or connected to any other game, publisher or comics franchise.
6. Updates and availability
We may update, change or discontinue the game, or any feature within it, at any time. We may also stop distributing it. We will not owe you compensation for virtual items if the game is discontinued, though we will try to give reasonable notice where we can.
7. Ending this agreement
You can end it at any time by uninstalling the game. We may end it if you materially breach these terms — in particular sections 2 and 3. When it ends, your licence ends and you must stop using the game.
8. No warranty
The game is provided "as is" and "as available". To the fullest extent the law allows, we make no warranty that it will be uninterrupted, error-free, or compatible with every device, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data or lost virtual items, arising out of your use of the game. Our total liability to you for any claim relating to the game is limited to the greater of the amount you actually paid us for in-app purchases in the twelve months before the claim, or ten United States dollars.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
10. Age
Spider Hunter is intended for players aged 13 and over. If you are under the age of majority where you live, you should review these terms with a parent or guardian, and only make purchases with their permission.
11. Changes to these terms
We may revise these terms. The current version will always be posted at this address with its effective date. Continuing to play after a change means you accept the revised terms.
12. Governing law
These terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Maryland will have jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country where you live.
13. General
If any provision of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us about the game.
